VA County to County Referendum: Supporting VA’s Defense of Rights

RESOLUTION TO PRESENT AN ADVISORY PUBLIC QUESTION VIA A COUNTYWIDE REFERENDUM IN THE MATTER OF SUPPORTING THE VIRGINIA DEFENSE OF RIGHTS


 


WHEREAS, the ____________ County Commission opposes the passage of any bill where the Governor, Attorney General, Virginia General Assembly, the Virginia Judiciary, or other public officials desire to restrict the individual rights of U.S. Citizens as protected in the United States Constitution and the Constitution of the Commonwealth of Virginia, and;


WHEREAS, the Right of the People to Keep and Bear Arms is guaranteed as an unalienable individual, civil, natural, and human Right under the Second Amendment of the United States Constitution and under the Constitution of the Commonwealth of Virginia under Article I, Section 13, and; 


WHEREAS, the Right of the People to Keep and Bear Arms for defense of Life, Liberty, and Property is regarded as an Inalienable Right by the People of  __________ County, Virginia, as stated in the Second Amendment to the U.S. Constitution “…being necessary to the security of a Free State,” and in Article I, Section 13 of the Virginia Constitution “…is the proper, natural, and safe defense of a free state,” and;


WHEREAS, the Rights enumerated under the First, Second, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth, and Fourteenth Amendments to the U.S. Constitution have been threatened by the Governor, Attorney General, the Virginia General Assembly, the Virginia Judiciary, and other public officials, and;


WHEREAS, the protections enumerated in the Virginia Declaration of Rights, Article I, Sections 1, 2, 3, 6, 8, 8-A, 9, 10, 11, 12, 13, and 15 have been grievously threatened by the Governor, Attorney General, the Virginia General Assembly, the Virginia Judiciary, and other public officials, and; 


WHEREAS, the People of __________ County, Virginia derive economic benefit from all safe forms of firearms recreation, hunting, and shooting conducted within the county using all types of arms, and;


WHEREAS, the __________ County Commission, being elected to represent the People of the County and being duly sworn by the Oath of Office to uphold the Constitutions of the United States and the Commonwealth of Virginia, and;


WHEREAS, the Virginia House of Delegates and the Virginia Senate, being elected by the People of the Commonwealth of Virginia, being duly sworn by the Oath of Office to uphold the Constitutions of the United States and the Commonwealth of Virginia, and;


WHEREAS, the Governor of Virginia and the Virginia Attorney General, being elected to represent the People of the Commonwealth of Virginia, being duly sworn by the Oath of Office to uphold the Constitutions of the United States and the Commonwealth of Virginia, and; 


WHEREAS, the various members of the Virginia Judicial branch, being duly sworn by the Oath of Office to uphold the Constitutions of the United States and the Commonwealth of Virginia, and;

WHEREAS, any bills under consideration by the Virginia legislature which would infringe on the Right to Keep and Bear Arms, and would ban the possession and use of firearms, magazines, and related items by peaceable citizens of __________ County, Virginia for defense of Life, Liberty, and Property; and would ban the possession and use of arms now employed for safe forms of recreation, hunting, and shooting conducted within __________ County, Virginia, and;


WHEREAS, in order to ensure the voices of the People of __________ County, Virginia are heard in Richmond, and throughout the Commonwealth and Nation, the __________ County Commission seeks to place an advisory public question before the electorate via a REFERENDUM on the November __, 2020 ballot seeking to inform the Governor of Virginia, the Virginia Attorney General, the Virginia General Assembly, and the Virginia Judiciary that the People of __________ County, Virginia *OPPOSE* any and all legislation, policies, and rulings which would infringe upon the Constitutional Rights of the People of __________ County, Virginia to Keep and Bear Arms, and to exercise all rights of Free people within the Commonwealth of Virginia.

BALLOT REFERENDUM:

“The People of __________ County, Virginia are *OPPOSED* to all attempts by the Governor of Virginia, the Virginia Judiciary, the Virginia Attorney General, and the Virginia General Assembly, in violation of their Oaths of Office, to infringe upon the Constitutional Right of the PEOPLE to Keep and Bear Arms, and the exercise of their rights as Free people within the Commonwealth of Virginia.”

NOW, THEREFORE, BE IT RESOLVED, by the __________ County, Virginia Commissioners that the aforementioned advisory question be presented to the electorate via a countywide referendum on the November __, 2020 ballot; and approved by vote, the results forwarded by the Clerk of __________ County to the Virginia House of Delegates, Virginia Senate, Office of the Governor, the Supreme Court of Virginia, and Office of the Attorney General.
